OK I have so many problems with this guy. one being while he played I take the 5th and I want to video this so I can try and be the next big internet thing, He took those law enforcement officers away from their real jobs. They are there to PROTECT US.. How many possible terrorists crossed that boarder while he was playing a game that my teenagers wouldn’t even play. I hope if he is a company driver that his company is notified and he is fired. This kind of crap makes life hard on other drivers.

No Warrent Needed to Search Commercial Vehicles for Criminal Evidence – State v. Hewitt

In State v. Hewitt, released this morning by the Appellate Division, the Court held that police may conduct regulatory searches of commercial motor vehicles without a search warrant under an exception to the warrant requirement for administrative searches of pervasively regulated businesses. In Hewitt, troopers stopped a commercial truck operated by the defendant and conducted a regulatory safety inspection. During the search, the troopers discovered a large hidden compartment in the vehicle. The troopers established that there were probably drugs hidden inside the compartment. They then arrest the operator, towed the truck away and conducted a search of the compartment. Drugs were hidden within the secret compartment.

The Appellate Division ruled that the regulatory search conducted by the troopers was authorized under federal law. The regulations authorize a safety search of every part of the vehicle, including hidden compartments. Accordingly, the drugs recovered in the secret compartment were lawfully seized.

i agree with you on thepoint of waking up and defending our rights..100% but it needs to be aimed at the correct locales..body scanners and porno searches at the airports..stop and frisk of the nypd..profiling by tennessee cops..etc etc..if you focus the laser at specific targets it has a much greater effect. they just ask you if you are a citizen andif there is anyone else in the truck..and actually in a commercial vehicle they have the right to ask you questions about your destination and the contents of your truck. Its not the same as a personal vehicle..notice he did that to border patrol and not a D.O.T. officer at an inspection..they can pull you over anytime they want and do a full inspection..of you and the vehicle..im surprised the officers didn’t pull him off to the side..detain him and tear his truck apart..the guys retarded..and he got lucky he did that to some border patrol that don’t know the actual law when it applies to commercial vehicles..

The officer gave him a lecture, and sent him on his way because the driver was within his rights!
There was One truck behind him…that is not the definition of a line.

As a commercial driver myself, when I was running the lower 48 I went thru this same immigration border check point. No you’ve not crossed the border, but being you’re in very close proximity as well as traveling beside the river that illegals cross to get in our country without being caught and then without a plan in place they seek transportation. Personally I believe border patrol officers should of searched his truck based on “suspicion”. This driver is a disgrace to the trucking industry. I’d love to see him with that same attitude with Department of Transportation Officers. Bet he wouldn’t get far!! Thanks Border Patrol for protecting our borders and doing what you do!!

Why is it that within our country we are supposed to PROVE that we belong here? As for them laying their “asses” on the line, they CHOSE that job, no one forced them to take it. Law enforcement does not have a right to climb up on your vehicle for any reason, either to ask you questions or whatever. If they wish to search my vehicle, then let them ask if I give my consent, don’t climb up on my truck so you can look around inside my cab. If they wish to question me then they can ask me to step out of my vehicle, instead of trying to intimidate me by basically climbing through my window at me. I might improperly come to the conclusion I am being attacked.

its a checkpoint coming out of laredo..where many illegals get dropped off in the area and hide in the airdams of trucks or inside the trailer they crawl up there while youe sleeping at the truckstop…in our yard it is required to look behind the airdam..the security at our yard shines his light up there for every trailer leaving..it happens..cry about illegal immigration and drugs coming across the border then cry also when they try to do a job you asked them to do to stop it..cant have it both ways..pick one and stand behind it..dont be wishy-washy..

Illegals have been known for hitching rides on unknowing drivers. They climb under trailers and hide up between the axles and the bottom of the trailer, on the tire rack, those skirts California are pushing so hard for are very helpful for these people, on the trailer roof up in the wind jam over the cab, in tool boxes on flat beds, in and under cars on car haulers. The best defense a driver has is to be respectful to the boarder patrol and let them check what they are supposed to. Searches made along the nation’s borders were authorized by the First Congress , in The Act of July 31, 1789. These searches can be made without a warrant, probable cause, or even some degree of suspicion. In United States v. Ramsey, the court stated, “That searches made at the border, pursuant to the longstanding right of the sovereign to protect itself by stopping and examining persons and property crossing into this country, are reasonable simply by virtue of the fact that they occur at the border, should, by now, require no extended demonstration”.[4]

People at immigration points may be searched and be held for up to 16 hours on reasonable suspicion alone.

New York does not perform vehicle searches unless they have a reason- that is left to officer discretion. They may enter or come close to the cab area to verify air pressure warnings or other inspection-related in-cab items. Unless they see something or have reason to believe there is contraband in the truck, they will not perform a search. Saying “no” to an officer who asks if he can perform a search of the interior of your truck is not considered “probable cause” for an inspection. But the officer may then choose to inspect your mattress, which would require him to enter the sleeper area with a tape measure…lol he can measure the size of the sleeper berth..inspect the mattress..check for item securement..granted he cant start tearing open all your cabinets without cause..but he is allowed by law to enter your cab for an inspection if he so desires.

I cant tell if this is the checkpoint on 281, but I have been heavilly harassed at it! Only time I’ve been through there, and it will be the last! The agent tried to open the door, but I had it locked. He then steped up on the step, reached in through the window, and unlocked the door, jerked it open, and stepped up into the cab (between me and the wheel), and started asking me questions! I answered their first two questions (very politely), and politely asked him to get the hell out of my truck! I was then asked all sorts of questions that had NO bearing on the reason fo these checkpoints! How many weapons I own, types, was I packing? Do you have a family, where are they? Where was I going, where was my home (not just the state, but specificts about location), I refused to answer these questions! I don’t quite agree with the way this guy handled thing, but we do have to stand up for ourselves once in a while! I deal with US Customs and Border Patrol on a regular basis, and their counter parts in Canada, and have NEVER been treated with anything but respect along the Northern border!

i been through that checkpoint hundreds of times..never got hung up for very long and never had an issue there..if they wanted to look in the back i would have to let them..in a commercial vehicle they have the right to look at your truck and cargo..they dont need probable cause or a warrant.

I would have LOVED seeing him pulled off to the side and givin the “fine tooth comb” treatment for about 5 or 6 hrs and then have his company called so he would be terminated on the spot. you can tell by the voice he is just a kid and a pain in the ass. they don’t have border patrol checkpoints 30 miles from the canadian border, this checkpoint was inside the U.S. 30 miles from the border. this would be like going through a border patrol checkpoint in toledo, Ohio & being asked if you are an American citizen.

he wasnt standing up for his rights as he had no legal leg to stand on..at any time a border patrol or D.O.T officer can inspect your truck and trailer and the contents..he was being a dick..the guys at this checkpoint are pretty cool guys just doing a job..and by law..a commercial vehicle operator as a professional..you have to answer their questions pertaining to your job..just yes..im a citizen..no there’s noone else in the truck and move on..guy was being a dick and hes lucky they didnt pull him over and tear his truck and trailer apart..cos they have every right to…i want to see him pull that shit at a D.O.T. inspection..im sure that would fly really well

If all this guy had to do (and any driver for that matter) is answer yes… Im alone… (lying or not), and then drive by, then what point does this check point serve ? If you refuse to answer via your rights, and then they get suspicious because you are not cooperating, it does not mean you suddenly have drugs or illegals on board… in fact, if you have done something illegal, its in your interest to lie and move on… again, emphasizing that this “choke” Point does nothing except force citizens to submit to authority and lay down their rights.

ok well then why are there many many instances of trucks being caught at this “useless checkpoint”? i have heard of illegals in the back of the truck..in the airdam..hundreds of pounds of mexican marijuana..all kinds of things..so you are saying that it should just be open and ..fk it whatever drug cartels want to unleash in the area is fine with you? It is totally less invasive than scanners at the airport..a dot checkpoint..so your saying when you pull in for a D.O.T. inspection you should tell them to get a warrant? People are amazing..cry about illegal immigration anddrugs flowing through the border but cry when the officers try in a non-invasive way just asking a couple questions..you cant have it both ways bro..ive been through that exact”chokepoint” many many times..never had a problem..flowed well..and the officers there are pretty cool and easy-going..theyre just trying to do a job..a job that was asked of them to do by now the same people that criticize them for doing their job..as for lying..wellthey do x-ray trucks and do have inspections for suspect vehicles..same as every countries border does..wether it be at the airport..rail station or road..so when you travel on an airplane and the security wants you to open your suitcase to be searched..you tell them get a warrant? get real man..its not a breach of your rights to answer a couple stupid questions..now if they had grabbed him out of his truck..tazered and pepper sprayed him..beat him several times with a club for no reason i would agree..og wait thats the nyc cops..or police officers in anti-protester gear..these guys arent those guys..if you want to fight this “rights” battle..fight it with the real enemy of your rights..not the ones doing their job to secure our borders..with needed cooperation with minimal hassle..
