Truck Driver Wins Sexual Harassment Suit

New York courts have sided with a truck driver who endured both sexual and racial harassment from his former boss, awarding him a massive $2.2 million settlement.

Truck driver Raymond Rosas said in his suit that his employers at Balter Sales Co. made frequent inappropriate sexual and racial comments and gestures during his employment.

Driver Says Boss Tried To Grope And Lick Him

Rosas claimed that his boss Barry Rosenberg drew images of male genitalia on his paycheck almost every week. He also claims that Rosenberg made repeated attempts to lick his face and grab his buttocks. According to the lawsuit, Rosas endured this behavior for about a year before he asked Rosenburg to stop.

Supervisor Belittled Minority Drivers

Rosas’s suit also accused supervisor Mark Balter of repeatedly making racist remarks and belittling minority drivers. Rosas, who is Hispanic, asked Balter to stop making inappropriate racial comments.

After complaining about the harassment, Rosas was accused of stealing restaurant equipment and terminated. His suit claims his termination was retaliation for speaking up against the harassment.

Company Had Truck Driver Arrested

Balter Sales filed a police report against Rosas for the alleged theft and had him arrested, but the charges were dropped.

Balter attempted to countersue for $700 for the stolen equipment, but the jury dismissed the suit.
