FMCSA Shuts Down Trucker After Fatal Pedestrian Strike

The FMCSA has ordered an Idaho trucker out of service following a fatal crash with a pedestrian that occurred when he was not qualified to drive a commercial vehicle.

According to the FMCSA, 41 year old Justin Dennis tested positive for methamphetamine during a USDOT-required drug test in January 2015. He was terminated by his employer and disqualified to operate a commercial motor vehicle.

Dennis reportedly failed to take the necessary steps to have his CDL reinstated.

On November 9, 2016, 24 year old motorist Matthew Martin was traveling west on I-84 near Boise when he lost control of his vehicle and crashed. After his car came to rest in the center lane, Martin exited the vehicle and was then struck by a semi driven by Dennis, who was still disqualified.

Martin died as a result of his injuries.

According to an FMCSA investigator, Dennis admitted to taking methamphetamine a few days before the crash. He also admitted that he had been texting while behind the wheel shortly before the crash occurred.

Investigators also found that Dennis was in violation of hours of service regulations at the time of the crash.

Dennis was served a federal order declaring him to be a hazard to public safety on November 18.
