FMCSA Proposes New Rules On Suspension and Revocation of Operating Authority The FMCSA has announced a proposed amendment that would allow the agency to suspend or revoke the operating authority of carriers who show a flagrant disregard for compliance. For some time, the FMCSA has drawn ire for its inability to prevent chameleon carriers from reopening under a new name.

Those who wish to provide feedback on the amendment may do so one of four ways: online, by fax, by mail or hand delivered.

[note color=”#a8a599″]SUMMARY: FMCSA proposes amendments to its regulations that would enable the Agency to suspend or revoke the operating authority registration of motor carriers that have shown egregious disregard for safety compliance or that permit persons who have shown egregious disregard for safety compliance to act on their behalf. These amendments would implement section 4113 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) as amended by section 32112 of the Moving Ahead for Progress in the 21st Century Act (MAP-21), and are designed to enhance the safety of commercial motor vehicle (CMV) operations on our nation’s highways.[/note]

Submitting Comments

If you submit a comment, please include the docket number for this rulemaking (FMCSA-2011-0321), indicate the specific section of this document to which each comment applies, and provide a reason for each suggestion or recommendation.
