South Dakota Approves Bill Boosting Trucker Rights

South Dakota joins Alabama, Minnesota, Utah, Wisconsin, Arizona and Oregon as the latest states to place restrictions on indemnity clauses in contracts provided by shipping companies. This is largely seen as a win for trucker’s rights and personal rights as well.

Indemnification clauses require freight carriers to take on liability for the negligence of shippers. As a result, truckers are responsible for trailer packing, even though shippers actually do the packing.
