William Michael Martin, former  Algood, Tennessee-based Songbird Trucking company owner, has been indicted by a Tennessee grand jury on 2 counts of theft for allegedly stealing over $10,000 from his employees’ 401 K and health insurance with holdings.
U.S. Marshal’s Task Force Agent Patrick Storie arrested Martin, the Herald Citizen reported.
Songbird employees noticed funds were withheld from their paychecks for retirement and health insurance; however, they had not been receiving those benefits. Â The employees then filed reports with the Department of Labor.
“The indictment alleges that between January of 2008 and April of 2009, he ‘unlawfully and knowingly exercised control over’ more than $10,000 belonging to Songbird 401K ‘with the intent to deprive the owners,'” Â the Herald Citizen reported.
According to the indictment, from January 2008 to April 2009, Martin allegedly “unlawfully and knowingly exercised control” over $20,000 of the employees’ with holdings.
Martin’s bond was set at $10,000, which he posted and was released. Â His trial is set for November 13, 2012.
