Pedestrian Claims Tire Blowout Aggravated PTSD

According to The Patriot-News, a military veteran claims he suffered physiological and physical harm when a truck hit a curb a blew a tire.  The force of the explosion knocked Falk to the ground.

The incident occurred on May 9, 2013, on Lincoln Avenue and Cumberland Street in Lebanon, Tennessee.

Ray J. Falk claims that as he was walking on the sidewalk near the intersection of Lincoln and Cumberland, a truck driver misjudged the turn, hit the curb, causing his tire to explode.

Falk said that the force of the explosion knocked him unconscious and that he sustained “severe trauma to his hearing and aggravated his preexisting mental health issues related to his military service.”

Falk is a decorated Navy veteran, who served in the early ’80s.  His attorney says Falk has been diagnosed with PTSD.

Falk is seeking $75,000 in damages. He is suing Western Express Inc. and the truck driver who “failed to keep his rig under proper control.”
