A deaf New York man is suing a truck driving school for discrimination after it refused to to allow him to attend classes.
According to the suit, 46-year-old Kenneth Frilando applied to the Smith & Solomon School of Tractor Trailer Driving, but the school would not admit him because of his disability.
Frilando, who has a Class A CDL permit in New York, applied for and received a safety waiver from the FMCSA indicating that he could safely drive a commercial truck.
Smith & Solomon’s director of safety issued a rejection email to Frilando stating:
“After considerable discussion at both the State and Federal level and having received little or no guidance on how to effectively train and safely protect the motoring public, the student and our personnel, we have determined that Smith & Solomon is not capable or qualified at this time to render the services requested”
Frilando’s suit claims that the rejection violates the Americans with Disabilities Act.
