OOIDA announced yesterday that they have filed a lawsuit against the FMCSA over its recent mandate that all truck drivers switch to electronic logging devices instead of paper logs.
OOIDA Attacks Electronic Log Mandate
OOIDA president Jim Johnston promised that his organization would fight the mandate with “everything we have available.” He also said that “this rule has the potential to have the single largest, most negative impact on the industry than anything else done by FMCSA.” Johnston claims that the new ruling will subject truck drivers to more pressure and stress than they already have to deal with.
Courts Have Sided With OOIDA on Electronic Log Issue Before
After years of debate, the FMCSA released their final ruling on electronic logs on December 10. The ruling gave driver two years, or until December 2017, to make the switch from paper logs to electronic logs.
In 2011, an appellate court sided with OOIDA and overturned a previous FMCSA ruling on ELDs.
OOIDA is currently choosing to keep the arguments it will use in court under wraps, stating in a press release that “arguments will be provided in subsequent filings and during oral arguments in front of the court.”
