FMCSA Forces Massachusetts Trucking Company Off The Road For Numerous Brake Failures

The FMCSA has declared Golden Eagle Delivery out of Lowell, Massachusetts, to cease all operations after repeated incidents of brake failure, one of which caused injury and serious property damage.

Brake Failure Caused Truck To Crash Into Home, Injuring Driver

According to the Out of Service order, a Golden Eagle Delivery truck crashed into a home on April 29, 2016 because the parking brake failed. This crash caused serious injury to the truck driver, along with significant property damages.

When the company’s vehicles were inspected on May 23, 6 of the 7 trucks were placed out of service for maintenance problems — mostly brake related.

Just a few days later, a Golden Eagle Delivery truck broke down on the side of the road and required towing because of brake failure.

Company’s Trucks Placed Out Of Service At Three Times The National Rate

Further investigation by the FMCSA found that were placed out of service at a rate of 73% in the past year. They also found that the company did not have a vehicle maintenance or repair program in place. The investigation also uncovered that Golden Eagle Delivery did not require truck driver to do pre or post trip inspections.

According to the Out of Service order: “Your continual and blatant disregard for our regulations including operating vehicles declared out-of-service based on unsafe conditions, all your vehicles having an out-of-service defect as reflected in the six vehicle inspections on May 23, 2016, and operating two vehicles after they were placed out-of-service), repeated citations for brake issues, and the fact that you have no vehicle maintenance program substantially increases the risk of death or serious injury if not discontinued immediately.
