OOIDA Takes The ELD Mandate To The Supreme Court

The Owner-Operator Independent Drivers Association has announced that it has filed a suit challenging the constitutionality of the ELD mandate with the U.S. Supreme Court.

OOIDA has called for review of a previous suit challenging the ELD mandate in the U.S. Court of Appeals for the Seventh Circuit. OOIDA’s argument against ELDs centers on the Fourth Amendment. They say that forcing truck drivers to use ELDS “is the equivalent of warrantless surveillance of truckers and that the government’s weak excuses for doing so fail to justify violating their Fourth Amendment rights.” The appeal argues that ELDs do not increase safety or reduce hours of service violations any more effectively than paper logs.

OOIDA’s appeal also asks the court to rule on whether ELDs violate the Fourth Amendment by “failing to establish a regulatory structure at the state and federal levels that serves as a substitute for a warrant.”
