Trucker Will Not Be Charged In Crash That Killed Two Children

Virginia State Police say that a truck driver was not at fault and will not be charged in a crash that killed two children running for the school bus this morning.

The incident happened just before 8 a.m. on Route 15 in Dillwyn, Virginia. A semi loaded with 75,000 pounds of mulch was headed northbound and downhill on Route 15 while a school bus was headed southbound on Route 15. Cousins five year old Tori Perez and six year old Jaiden Bartee were waiting at the bus stop with four other children when they saw the bus approach. Excited, they ran into the road as the bus was slowing to pick them up.

The bus driver realized that the northbound semi was not going to be able to stop in time and motioned for the children to get out of the roadway. The trucker slammed on his brakes, leaving skid marks on the road, but was unable to stop and fatally struck the kindergarteners.

There are no violations on this,” said a spokeswoman for the Virginia State Police. The sixty-six year old truck driver, who has not been identified, was properly licensed and after his truck was inspected, no violations were discovered. He will not face charges in this crash.

There were no other injuries reported.
