The family of a toddler killed after a cement truck skidded off an overpass and landed on their car has filed suit against the cement truck company.
The paperwork for the lawsuit was filed on August 8th by the Resendiz family against National Ready Mix. The plaintiffs are listed as Jennifer and Maria Resendiz, the mother and grandmother of the almost two-year-old victim.
The lawsuit cites negligence against the cement truck company, and the family is seeking more than $1 million in damages for injuries sustained in the wreck, subsequent medical treatment, and wrongful death damages, reported Click2Houston.
The lawsuit states that Jennifer Resendiz deserves to be compensated for the past and future loss of the companionship, society, love, and affection resulting from the death of her son Nicolas, and for the mental anguish, grief, and sorrow that she has suffered since his death and in the future for the rest of her life.
“This family will always carry the burden of their grief for the loss of their precious son, grandson, and brother. Were it not for the careless action on the part of the trucking company, he would be here today. Now, the mother and grandmother will live with the physical injuries they sustained and the unimaginably painful loss of their beloved little twin boy, Nicholas,” says the family’s Attorney Terry Bryant.
