Florida trucking company shut down by FMCSA following double fatality crash

The Federal Motor Carrier Safety Administration (FMCSA) issued a federal out of service order to a small Florida motor carrier in the wake of a fatal crash.

On January 14, 2022, the FMCSA ordered West Palm Beach-based carrier Professional Marine Hauler’s LLC and principals, Claudia Angeligue Abreu and Ariel Martinez to immediately cease all interstate and interstate operations.

The out of service order was issued following a November 9, 2021, collision that left two people dead and nine others injured.

According to officials, the post-crash investigation revealed “egregious levels of non-compliance and a complete failure of the carrier and its owners to implement any aspect of a safety management plan. This failure resulted in the fatal crash, which was caused by complete trailer brake system failure. The Agency’s compliance investigation found Professional Marine Hauler’s and its principals, Claudia Angelique Abreu and Ariel Martinez, operating CMVs with a total disregard for safety.”

FMCSA investigators also discovered a “pattern of non-compliance” associated with other motor carriers operated by Claudia Angelique Abreu and Ariel Martinez. This pattern included violations documented during roadside inspections and failed new entrant safety audits.

The agency went on to say that Abreu and Martinez continued to operate unsafe vehicles in interstate commerce even after they were placed out of service.

“The two company principals showed a total disregard for vehicle maintenance, driver qualifications, controlled substances & alcohol testing, hours of service and oversize/overweight limits for CMVs,” the FMCSA said in a news release.
