Motorist awarded $2M after rig knocks car off interstate

A motorist recently received a $2 million settlement for a wreck with a tractor trailer that knocked his car off the interstate.

The accident happened on June 25th, 2019, but the subsequent lawsuit was settled this year. 

According to Daily Voice, 49-year-old Kevin Smith was heading east in the slow lane on Route 80 in Morris County, New Jersey when a semi truck drifted out of the center lane and into the slow lane, bumping Smith’s car. The force of the impact sent the car skidding off of the highway and Smith was injured as a result. 

After the incident, Smith underwent surgery for “multiple fractures and herniations of the lumbar spine,” and spent a week in a rehab center. He was able to return to work in September of that year. 

In the lawsuit, Smith and his attorneys argued that he continues to suffer from back pain and that his pain has forced him to abandon hobbies such as skiing, and limited him in his ability to help around the house. Smith also says he now requires physical therapy and pain management treatment. 

The lawsuit was aimed at both the truck driver and the trucking company, whose arguments stated that Smith had recovered well from his injuries. 

The $2M settlement was reached through mediation.
