OOS truck driver arrested on outstanding warrant for New Year’s Eve crash into home

A truck driver was arrested this week for a fatal New Year’s Eve crash that led to him being placed out of service. 

The accident happened back on December 31st, 2020 in Mesa, Arizona. 58-year-old Daniel Tobon was taken into custody on an outstanding warrant on July 3rd. 

According to 12 News, Tobon likely experienced a medical emergency that led to him crashing into a home with 10 people inside. Tobon has since been placed out of service for fraudulently certifying medical records needed to obtain a commercial driver’s license. 

FMCSA investigators found that in September 2020, Tobon had fraudulently certified his USDOT/FMCSA medical examination report form; he also fraudulently certified the form previously in September 2018,” the US Department of Transportation wrote in a release.  

Tobon is facing 15 felony charges including manslaughter, aggravated assault, criminal damage, several counts of endangerment, and forgery. He is scheduled to be arraigned Friday, June 7th in Maricopa County Superior Court.
