Oregon trucking co. and owner sentenced for ‘deletes and tunes’ on 13 semi trucks

A trucking company and owner were sentenced this week for violations of the Clean Air Act related to semi truck emissions control tampering.

Clancy Logistics, Inc., located in Fairview, Oregon, and its owner, Timothy Curtis Clancy, 55, of Sherwood, Oregon, were each sentenced to three years of probation as well as a fine of $101,510, according to U.S. Attorney’s Office for the District of Oregon.

Clancy Logistics and Clancy were charged in September 2024 with two counts of Clean Air Act tampering. Both Clancy Logistics and Clancy pleaded guilty to one count of tampering with a monitoring device.

Officials say that between October 2019 and July 2023, Clancy performed “deletes and tunes” to illegally disable emissions control systems on at least thirteen semi trucks in his fleet.

“Clancy, as owner of Clancy Logistics, oversaw the illegal modification of vehicles, including engaging in and directing employees to remove the emissions control equipment and tune the onboard diagnostic systems so it could no longer detect the removal of control equipment. Clancy Logistics knowingly operated the altered vehicles,” the U.S. Attorney’s Office said.

The case was investigated by the Environmental Protection Agency’s Criminal Investigation Division.
