Trucker suing driver & company for $1M after failure to yield crash

A truck driver is suing a trucking company and another truck driver after a failure to yield crash in Texas earlier this month. 

The accident happened on October 15th, at U.S. 285 and State Highway 302 in Reeves County, Texas. The lawsuit was filed on October 28th. 

According to KMID Midland, truck driver David Noel Montanez is suing Truway Xpress LLC of Odessa and truck driver Tony Gamboa Barrientos, alleging that Barrientos caused the failure to yield crash. The suit states that Barrientos “failed to yield right of way at a stop intersection and attempted to turn southbound on US HWY 285,” causing him to drive right into the path of Montanez’s oncoming semi truck. 

Montanez’s semi truck overturned as a result of the crash and came to a stop upside down on the roadway. Both drivers were transported to a nearby hospital. Barrientos was cited for fail to yield the Right of way (stop intersection) and was listed at fault. 

The suit states that Barrientos caused the crash though negligence, and that the trucking company he was driving for, Truway Xpress, is also at fault for putting him behind the wheel of a commercial vehicle. The suit claims that Truway Xpress hired Barrientos without proper screening, did not provide proper training, and supervised him improperly. The suit also points out that Montanez was not cited, and there were no adverse weather conditions at the time of the crash. 

The lawsuit seeks more than $1 million in damages and has been filed in the 161st District Court of Ector County, Texas.
