Bill to require Arizona cops to seize and sell semi trucks if drivers illegally present in U.S. possess a fraudulent CDL

A bill recently introduced by an Arizona lawmaker would require police to seize a driver’s semi truck as a forfeiture if it is determined that the driver is not lawfully present in the U.S. and possesses a falsified commercial driver license (CDL).

State Rep. David Livingston introduced House Bill 2345 in the Arizona House of Representatives on January 15, 2026.

The bill establishes it as a Class 5 Felony in the state of Arizona if a person who is present in the U.S. illegally possesses a falsified CDL.

It also requires police to seize the semi truck of any person illegally in the U.S. who presents a fraudulent CDL, and to sell the truck if the commercial vehicle is titled to the violator.

Additionally, if the commercial vehicle is titled to a person “who knowingly employed the violator,” the truck is to be sold and “the employer [must] pay a civil penalty equal to the fair market value of the commercial vehicle seized.”

All proceeds from the sold trucks would be placed in the Highway User Revenue Fund (HURF), which provides revenue for state infrastructure projects.

While the AZ Mirror reports that some lawmakers expressed concerns about the enforceability of the bill, an amended version of House Bill 2345 advanced out of the House Judiciary Committee with a vote of 5 Yes to 3 No on January 28.
