Former workers sue defunct trucking company Yellow Corp. over data breach

Former Yellow Corp. employees sued the shuttered trucking company over a data breach that they say left their personal information exposed for more than a year.

On July 30, 2026, a group of former Yellow workers including Randolph Davis, Timothy O’Brien, and John Payton filed a proposed class action lawsuit in a Delaware Bankruptcy Court against Yellow Corp. and a liquidating trustee over a data breach that happened last year.

According to the suit, on March 27, 2025, “Yellow discovered that it had lost control over its computer network and the highly sensitive personal information stored on its computer network in a data breach perpetrated by unauthorized third parties.”

The data breach affected of thousands of employee records, including names and social security numbers going back twenty years, the suit alleges.

The Yellow workers say that the company did not provide notice of the data breach until June 26, 2026, fifteen months after the breach occurred. The gap between the data breach and the notification of former employees left them vulnerable to identity theft and other kinds of cyber crime, the suit said.

Plaintiffs said that the data breach impacted them in a variety of ways, including an increase in spam calls, unauthorized charges to credit cards, and stress and anxiety over the loss of their personal information. One plaintiff said that he froze his credit with all the three main credit bureaus to mitigate the risk of fraud and identify theft.

The lawsuit alleges that Yellow failed to use proper cybersecurity measures recommended by the Federal Trade Commission to protect employee data. The workers also said that Yellow “has not provided any compensation its former employees victimized in the Data Breach and has not offered to provide any assistance or compensation for the costs and burdens—current and future—associated with the identity theft and fraud resulting from the Data Breach.”

The suit seeks both damages and equitable/forward-looking relief for the Plantiffs as well as a proposed class of U.S. individuals who were affected by the data breach.

Yellow Corp. filed for bankruptcy protection and wound down operations in August 2023 after nearly 100 years in business following a dispute with the International Brotherhood of Teamsters (IBT) over a plan to combine the operations of YRC Freight, Reddaway, Holland, and New Penn into a single carrier providing both regional and long haul services.
