Potential added fine for H-1B renewals still waiting on final ruling

A potential $4,000 fine for employers looking to renew the H-1B visas of current employees has yet to receive a final ruling. 

The Department of Homeland Security introduced the potential renewal fine in the Spring of 2025, but the Final ruling on the matter was pushed to July 2026. Now, it appears a final decision has still not been reached. 

According to DHS document, the employer seeking a H-1B visa renewal for an employee would pay an undetermined fine for the renewal. Currently, employers must only pay the $4,000 fine for the initial grant of status, or when there is a change of employer.The fine would apply to employers with more than 50 employees who with more than 50% of their workforce on H-1B or L-1 status. 

The fine was initially established to help fund the government’s system for recording and verifying people entering and exiting the United States.
