Wrongful death lawsuit filed against HEB, trucking company, & driver after four killed in car with flat tire

A wrongful death lawsuit has been filed against HEB and others after a crash involving a semi truck killed four people inside of a car with a flat tire. 

The lawsuit was filed on December 23rd, 2025 in Bexar County Court in Texas for a November 2025 accident in Dalhart, Texas. 

According to KSAT, four women ranging from 19 to 30-year-old were driving slowly in the southbound lanes of US Highway 87 with their hazards on after experiencing a flat tire. A semi truck driven by Guadalupe Villereal then crashed into the back of the slow moving vehicle, pushing the vehicle across multiple lanes of traffic. The semi truck also overturned as a result of the wreck. All four women inside of the car were killed. 

“The shocking footage shows this driver failing to control his speed or be remotely aware of his surroundings,” a spokesperson for the victims said in part. “We intend to hold the defendants fully accountable for their actions and extreme negligence in such an avoidable tragedy.”

The suit seeks an unspecified amount in damages, including mental anguish, pecuniary losses, funeral expenses, and loss of companionship. The suit also requests that the court grant a temporary restraining order and a temporary injunction to preserve evidence such as dash cam footage from the semi truck and Villereal’s mobile devices.  

The suit alleges negligence and careless disregard of duty against the defendants. The suit names HEB, Parkway Transit Inc, Scrappy Trucking LLC, and Villareal.
