Brothers arrested after challenging delivery driver to a fight, firing shots

A delivery truck driver says two brothers “nearly ran him off the road” in Utah earlier this week during an apparent road rage confrontation. 

The series of incidents happened in Mill Creek, Utah on Monday, July 3rd. 

According to Gephardt Daily, the delivery truck driver was on Interstate 80 eastbound exiting onto 700 East when a silver Hyundai car suddenly veered across four lanes of traffic and “nearly ran him off the road.” The delivery truck driver says he honked his horn in response and turned right onto 700 East going south. The Hyundai then pulled up next to him and both the motorist and the passenger flipped him off, swore at him, and called him a racial slur. The two men, identified by police as brothers, then yelled at the delivery truck driver to stop and challenged him to a fight. 

The delivery truck driver continued on and turned onto 3300 South but the two brothers followed him and eventually pulled in front to brake check him. The delivery truck driver then decided to pull over, hoping the men would continue on their way, but instead the car also stopped and the two men got out. The trucker then pepper sprayed the two men, and the two backed off. All three men then drove away from the scene. 

A short time later, the delivery truck driver saw the Hyundai again and heard gunshots, so he ducked down to avoid being hit before following the car and calling 911. Police eventually found the suspects, who fled police at 100 mph and eventually crashed into another car and flipped, landing on their roof. 

The driver of the car, 22-year-old Adrian David Brown, was taken into custody while the passenger,  24-year-old Tyler Joshua Foutz, was taken to the hospital in unknown condition. Police found a 9mm magazine in the Hyundai and one used shell casing in the crash debris. More 9mm casing were also discovered at the location where the delivery driver said the shooting occurred. 

Brown denied any wrongdoing while speaking with police and claimed that he didn’t see officers trying to pull him over. He also claims his brakes didn’t work at the time of the crash, and says that the delivery truck driver instigated the incident and challenged them to a fight. He told officers that “he wasn’t the one who fired the gun.” 

Foutz was later arrested on six felony counts, including discharge of a firearm in the direction of a person, aggravated assault, and use of a firearm by a restricted person. Brown was arrested for failure to stop at the command of police, driving under the influence, reckless endangerment and reckless driving.
