Proposal requiring law enforcement to arrest any undocumented migrant found driving semi truck filed by Florida Senator

A proposal that would require law enforcement to arrest any undocumented migrant found behind the wheel of a commercial vehicle was filed by a Florida Senator on Thursday. 

Bill SB 86 was filed on September 25th by Senator Don Gaetz from Florida. 

According to the Bill text, SB 86 would require any law enforcement officer that discovered an undocumented migrant driving a commercial vehicle to take that person into custody and facilitate the transfer of that individual into federal custody. 

The bill would also require that the commercial vehicle driven by the undocumented migrant be impounded and the owner fined $50,000, which must be paid in order to get the vehicle back. 

“A motor carrier that owns, leases, or otherwise operates a commercial motor vehicle operated by a person who is taken into custody pursuant to this section may not operate in this state,” the bill reads.

If the bill is passed, it will go into effect on July 1st, 2026.
