According to the Federal Register, the Department of Energy is seeking an exemption from the HOS 30-minute break rule.
If granted, the exemption would allow Department of Energy contracted carriers and their drivers to transport “security-sensitive radioactive materials” the same treatment provided to drives hauling explosives.
“The exempted drivers would be allowed to use 30 minutes or more of attendance time to meet the HOS rest break requirements providing they do not perform any other work during the break. FMCSA requests public comment on DOE’s application for exemption,” the petition states.
The FMCSA is seeking the public’s input on the exemption. All comments must be submitted by February 13, 2013.
