Pilot Flying J, Truck Driver Settle Toilet Seat Lawsuit

According to the WCF Courier, a settlement has been reached between Pilot Flying J and a truck driver who said he was injured when he slipped and fell off of a broken toilet seat at an Evansdale, Iowa truck stop.

The WCF Courier reported that the case was scheduled to go to trial in August, but on July 23, both sides agreed to an undisclosed settlement.

On February 17, 2010, Douglas E. Blouin, 47, used the Pilot Flying J restroom.  As he was sitting on the toilet, he shifted his weight and fell from the seat and struck his head.

He left the truck stop and began driving. Two hours later, he got a severe headache.

In 2011, he filed a lawsuit against Flying J for the incident, claiming that the company was negligent.

“During preparation for trial, attorneys for Flying J requested an independent examination, and the doctor who was hired opined that Blouin didn’t sustain permanent partial disability or impairment, court records indicate. The doctor said the surgeries had no connection with the toilet accident, and he said the pain and headaches were pre-existing problems that dated back several years, records state,” the WCF Courier reported.
