Dump truck driver’s widow files lawsuit for dangerous train crossing that she claims cost him his life

The widow of a trucker killed by a train in Missouri last year has filed a lawsuit against BNSF for the accident. 

Erin Barton sued the train track owner, BNSF in July 2022 for the crash that happened in June 2022. 

According to ABC 17, Barton alleges that her husband, dump truck driver Billy Barton II, died in the accident due to the steep incline, lack of warning devices, and poor visibility due to the angle and overgrown brush. 

The train crashed into the truck at 87 mph. Three passengers inside of the train were also killed in the crash, and 150 people were injured. 

The wrongful death lawsuit has been scheduled for a two week trial starting October 28th, 2024.
