Buc-ee’s suing gas station with two stores for “ill-gotten gain” through use of similar logo

Buc-ee’s is claiming copyright infringement against a small gas station in the Dallas area due to their similar logo. 

Buc-ee’s filed a lawsuit in US District Court, claiming the logo used by Super Fuels is too similar to the Buc-ee’s Beaver. The Super Fuels logo is a brown dog in a cape. 

The lawsuit states that the Super Fuels logo features an  “anthropomorphic and cartoon representation of a smiling animal that closely resembles a beaver, which is similarly positioned in a right-facing angle and is depicted in front of a circular background,” reported Fox 4 News.

The suit also points out that the Super Fuels dog is wearing similar clothing and has a similar expression. Buc-ee’s claims that the similarity of the logo may confuse customers, leading to a loss in sales for Buc-ees’s.

The suit calls for a permanent injunction to stop Super Fuels from using the dog logo. The suit also demands that Super Fuels pay Buc-ee’s for any “ill-gotten gains,” and that the company destroy all signs, packaging, and other merchandise featuring the dog logo. 

Super Fuels owns two locations – one in Dallas, Texas and one in nearby Irving.
