A truck driver’s family has filed wrongful death lawsuit against the Florida Highway Patrol (FHP) and the estate of a deceased trooper following a fatal crash that occurred during a high speed police pursuit last year.
The family of truck driver Arsenio Más, 55, filed a suit against both FHP and the estate of Trooper Zachary Fink on December 27, according to TCPalm.
Más died in a crash in St. Lucie County, Florida, on February 2, 2024.
Trooper Fink, 26, was pursuing Kia driver Michael Anthony Addison, 32, on I-95 when the crash occurred.
“Trooper Fink, who was in the area, saw the vehicle make a U-Turn and begin driving in the wrong direction. Trooper Fink then moved to make a U-Turn, and his vehicle was struck by a semi-truck near mile marker 120 southbound [on I-95],” said the Florida Department of Highway Safety and Motor Vehicles shortly after the crash.
Más died at the scene and Fink passed away in a hospital shortly after the crash.
The lawsuit accuses Fink of operating recklessly during the police pursuit, and stated that Fink “cut across all southbound lanes of traffic, from the outside lane to the inside lane, in pursuit … Unsurprisingly, defendant Zachary Fink cut off Arsenio Más’s lane of travel and caused a violent collision.”
The suit also alleges that Fink drove at speeds of up to 120 m.p.h. during the pursuit and that he disobeyed FHP policies.
